Welcome to Issue # 8 of Write it Right! This week’s issue features a case decided last week. It’s an important case for authors for a few reasons. First, it features a hybrid publisher, who is sued in state court for allegedly overcharging publishing costs. Second, it showcases how breach of contract and copyright law intersect in a federal court case. Copyright law falls under federal law, whereas contract law is a state matter. The issue here is which court (federal court or state court) is the correct venue to hear the case. While this case is mainly jurisdictional, it illustrates how copyright and contractual matters can be interrelated (as you see in your publishing agreements).
